These Terms of Service ("Terms") are a binding agreement between you and Balenafi ("Balenafi," "we," "us," or "our") governing your access to and use of balenafi.com, our web application, and all related services (together, the "Service"). Please read them carefully — they include a limitation of liability, a mandatory arbitration or forum clause in Section 18, and important disclaimers about what the Service is and is not.
By creating an account, clicking to accept these Terms, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Risk Disclosure, both of which are incorporated into these Terms by reference. If you do not agree, you must not access or use the Service.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.
You must be at least 18 years old, and legally capable of entering into a binding contract, to create an account or use the Service. The Service is not directed at, and must not be used by, anyone under 18.
Balenafi presents information derived from public activity on Polymarket, a prediction market platform operated independently of Balenafi. Access to and trading on Polymarket itself is subject to Polymarket's own terms and to the laws of your jurisdiction, which may restrict or prohibit participation in prediction markets or derivatives trading for residents of certain countries or states. You are solely responsible for determining whether it is lawful for you to view whale-tracking data, receive trade signals, or trade on Polymarket where you live, and for complying with all applicable laws. Balenafi does not verify your eligibility to trade on any third-party platform and does not offer the Service in any jurisdiction where doing so would violate local law.
You need an account, authenticated by email and password through our identity provider, to access most of the Service. You agree to:
We may suspend or terminate your account under Section 16 if any information you provide turns out to be inaccurate, misleading, or fraudulent.
Balenafi monitors public, on-chain Polymarket trading activity, identifies traders with a sustained public track record of profitability ("whales"), and produces a composite, backtested score for markets where multiple whales independently hold the same position. Depending on your subscription tier, the Service may also provide: a real-time signal feed, pump-and-dump detection alerts, once-daily AI-generated recommendations, on-demand AI deep research on individual markets ("Poseidon"), exit signals on positions you log, watchlists, and self-reported portfolio and trade tracking.
The Service displays information for your own reference. It does not place trades, manage funds, or otherwise act on your behalf on Polymarket or any other platform. Any trade you log in Balenafi is a manual record you create for your own tracking purposes; logging a trade in Balenafi has no effect on any position you hold or intend to hold on Polymarket or elsewhere.
We continuously develop the Service and may add, change, limit, or remove features, including features tied to a specific subscription tier, at any time as described in Section 17.
Balenafi is an informational and analytical tool. It is not a broker-dealer, investment adviser, financial planner, commodity trading advisor, or fiduciary of any kind, and nothing in the Service constitutes an offer, solicitation, or personalized recommendation to buy, sell, or hold any position on Polymarket or any other platform. Confidence scores, whale-consensus signals, AI recommendations, Poseidon research reports, and exit signals reflect a probabilistic assessment of publicly available data at a point in time. They do not account for your personal financial situation, risk tolerance, or objectives, and they are not a guarantee of any outcome. Please read our Risk Disclosure in full before acting on anything you see in the Service — it is part of these Terms and describes the risks of prediction-market trading in detail.
Certain features — including AI Recommendations, Poseidon Deep Research, and any other output labeled as AI-generated — are produced by third-party large language models processing whale-positioning data and, where applicable, live web search results. AI- generated content:
We instruct our AI systems to reason critically about the underlying data rather than simply restate scores, and we work to improve their accuracy over time, but we do not warrant the accuracy, completeness, or reliability of any AI-generated output.
The Service is offered on a free tier and on paid subscription tiers (currently "Signals" and "Pro") at the prices and with the features listed on our Pricing page at the time you subscribe. Prices are shown in euros (EUR) and exclude any value-added tax, sales tax, or similar levy, which will be added where applicable at checkout.
Paid subscriptions are billed in advance on a recurring monthly basis and automatically renew each month at the then-current price until you cancel. Payments are processed for us by Stripe, Inc.; Balenafi does not receive or store your full card number. By subscribing, you authorize us (through Stripe) to charge your chosen payment method on each renewal date until cancellation.
We may change subscription pricing or introduce new tiers at any time. If a price change affects your existing subscription, we will give you reasonable advance notice before it takes effect on your next renewal; continuing to use a paid tier after that notice period constitutes acceptance of the new price.
You may cancel your subscription at any time from your account settings or by contacting support@balenafi.com. Cancellation stops future renewals; you will keep access to your paid tier's features through the end of the billing period you already paid for, and you will not be charged again afterward.
Except where required by law, fees already paid are non-refundable, including for partial billing periods, unused features, or downgrades made mid-period. If you believe you were charged in error, contact us within 30 days of the charge and we will investigate in good faith.

We may investigate suspected violations and take action under Section 16, including rate limiting, suspension, or termination, without prior notice where we reasonably believe it is necessary to protect the Service or other users.
Balenafi is an independent product and is not affiliated with, endorsed by, or sponsored by Polymarket, any blockchain network, or any third-party AI provider we use. Whale positioning data is derived entirely from publicly available on-chain and API data published by Polymarket; we do not have any special or private access to Polymarket order flow, and we do not control the accuracy, completeness, timeliness, or availability of that data. Polymarket may change its data formats, rate limits, or availability at any time in ways that degrade or interrupt the Service, and we are not responsible for any such change.
The Service also relies on infrastructure and processing provided by third parties, including cloud hosting and authentication, a managed database, payment processing, and AI model providers. Outages, errors, or changes at any of these providers may affect the Service's availability or accuracy, and we are not liable for issues that originate outside our own systems.
The Service, including its scoring methodology, software, design, text, graphics, logos, and the Balenafi name and marks, is owned by Balenafi or our licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use.
We do not grant you any right to use Balenafi's trademarks, branding, or the substance of our scores and research (as opposed to your own screenshots or personal notes) for any public, commercial, or redistributive purpose without our prior written consent.
If you send us feedback, bug reports, or feature suggestions through the Service or otherwise, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose, including improving the Service, without any obligation to compensate or credit you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any score, signal, alert, or AI-generated output will be accurate or will result in a profitable or successful trade. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALENAFI AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY TRADE YOU MAKE OR DO NOT MAKE ON POLYMARKET OR ANY OTHER PLATFORM, OR ANY SCORE, SIGNAL, ALERT, OR AI-GENERATED CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in subscription fees during the three months immediately before the event giving rise to the claim, or (b) fifty euros (€50). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for death, personal injury, or fraud.
You agree to indemnify and hold Balenafi and its officers, employees, and contractors harmless from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to: your violation of these Terms; your violation of any applicable law; any trading decision you make on Polymarket or elsewhere; or your infringement of any third-party right.
You may stop using the Service and delete your account at any time by contacting support@balenafi.com. We may suspend or terminate your account or access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or if we discontinue the Service. Sections 5, 6, 11 through 15, 18, and 19 survive any termination of these Terms.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; if we make material changes, we will post the updated Terms on this page with a new "Last updated" date and, where required by law or practical, provide additional notice (such as an in-app notice or email). Continued use of the Service after an update takes effect constitutes acceptance of the revised Terms. If you do not agree to an update, you must stop using the Service and may cancel any subscription as described in Section 8.
These Terms are governed by the laws of [Governing law jurisdiction — e.g., Ireland / a named EU member state], without regard to its conflict-of-laws principles, except to the extent applicable consumer protection law in your country of residence provides you with additional rights that cannot be contractually waived. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in [Venue — e.g., city, country], and you consent to personal jurisdiction there, unless applicable law requires a different venue for consumer disputes.
These Terms, together with the Privacy Policy and Risk Disclosure, are the entire agreement between you and Balenafi regarding the Service and supersede any prior agreements on the same subject. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Balenafi.
